Notice of breach of EU regulations / e-privacy directive

Yesterday, I signed in to my account for the first time in many months ONLY to check that I had the latest version of evolution 8. As a consequence of this, you changed my email communication preferences from 'do not send' to 'do send'. You did this without  warning or notification and WITHOUT MY AGREEMENT. Although I checked and reset my preferences within a few minutes of signing-on I have today received an unauthorised and unwanted email newsletter today. Such emails are intrusive and distressing. They are SPAM MESSAGES. I understand that the EU e-privacy directive which applies here in the UK is also implemented in Italy, and this requires you to get prior consent before opting-in. It is unacceptable that you opt customers in to your database simply because they access their account on an unrelated matter that has nothing to do with sales. IT IS UNACCEPTABLE THAT EVERY TIME I ACCESS MY ACCOUNT TO CHECK FOR LATEST VERSIONS AND / OR TO FIND ANSWERS TO PROBLEMS YOU WILL TRY TO FORCIBLY OPT ME IN TO THE NEWSLETTERS.

Why did you ignore my previous marketing preferences and make these changes? Why do you consider that this is an appropriate way for a professional organisation to behave?

For your information I was looking at your website to research evolution 9 which I was considering buying. However, I have cancelled this purchase because of the way you have behaved.

I do not EVER wish to receive marketing or upgrade information. If you continue to ignore my wishes you will also lose sales of subsequent versions, and I reserve the right to report your breach to the relevant authorities.

Please note that copies and screen-prints of this message will be created and retained.

Hello J.G.,

I'm sorry that you received one of our emails even if you removed your account from our database. I confirm you that any user is free to choose which type of emails to receive from Incomedia. You simply need to access to your profile page and select the options you want. Here is a screenshot:

I confirm you that after you set your preferences on your Profile, these settings will not be changed automatically every time you log in. Infact I can see that actually your settings are all set to OFF. Please confirm.

Some of the reasons why you received a newsletter from us yesterday could be:

  1. the email was already scheduled and your settings were not applied yet
  2. there was an error in the link between your settings and the database and your account has not beed removed. We need to verify!
  3. you received the newsletter to another email address, different from the one you have registered here.

I kindly ask you to give me some info regarding the email you received (a screenshot)  and check if the destination address is the same of the one you have here.

If it is different, simply give me this email address, so we can be sure to remove it from our database. Note that every user is always able to remove his address from our newsletter database simply accessing to the UNSUBSCRIBE link present at the bottom of every email.

I am also receiving junk mail and all the options are unchecked. This was done already last month. I am receiving two of everything. Please remove me from your mailing lists. No longer needed.
